The National Association of State Charity Officials has developed guidelines called The Charleston Principles to help nonprofits determine when state registration is required to solicit charitable solicitations via the internet:
- A nonprofit must register with the state agencies of the state in which it is domiciled.
- An organization must register with the state agencies of all states in which it actively solicits contributions.
- If an organization has not registered with a particular state, but receives contributions from donors in that state, the organization must either register with that state’s agencies or clearly note on its website that it will not accept contributions from residents of that state.
